Terms of Use and Platform License

Nation is a professional developer community and technology platform that may include, among other things:

• developer profiles and professional identity features
• job discovery, applications, matching, and employer workflows
• skills testing, assessments, benchmarking, and validation features
• educational content, learning journeys, and career development tools
• messaging, community, and collaboration features
• AI-assisted tools, recommendations, and automated workflows
• dashboards, analytics, and platform administration features

The Platform is made available for professional, educational, informational, and related commercial purposes, subject to these Terms.

Nation may add, remove, modify, suspend, or discontinue any feature, functionality, workflow, content category, integration, or service at any time.

By using the Platform, you represent and warrant that:

• you are at least sixteen (16) years old, or older if required by applicable law to validly use the Platform;
• you have the legal capacity to enter into these Terms;
• all information you provide to Nation is true, accurate, current, and complete;
• your use of the Platform will comply with applicable law and these Terms; and
• if you are acting on behalf of an organization, you have authority to bind that organization.

Nation may refuse access to the Platform or require additional verification if eligibility, identity, authority, or compliance is reasonably in doubt.

To access certain parts of the Platform, you may need to create an account.

You are responsible for:

• maintaining accurate, complete, and up-to-date registration, profile, and account information;
• maintaining the confidentiality of your credentials;
• restricting access to your account and devices;
• all activities conducted through your account, whether or not authorized by you, except to the extent caused by Nation’s own breach of applicable law or these Terms.

You must notify Nation promptly if you suspect unauthorized access, credential compromise, account misuse, or any other security incident affecting your account.

Nation may require identity verification, profile verification, employer verification, or other reasonable checks before allowing access to certain Platform features.

Subject to your compliance with these Terms, Nation grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Platform solely for its intended purposes and only in accordance with these Terms.

This is a license to use the Platform, not a sale, transfer, or assignment of any software, technology, intellectual property, or other rights.

Except as expressly permitted by Nation in writing, you may not:

• copy, reproduce, distribute, publish, lease, rent, sell, sublicense, assign, or commercially exploit the Platform;
• modify, adapt, translate, mirror, frame, or create derivative works based on the Platform;
• reverse engineer, decompile, disassemble, decode, extract, or otherwise attempt to derive source code, underlying models, datasets, structures, workflows, scoring logic, architecture, or non-public functionality;
• access or use the Platform to build, train, improve, benchmark, or support a competing service, model, marketplace, hiring platform, skills platform, learning platform, or developer network;
• use the Platform except as expressly allowed by these Terms and applicable law.

Any rights not expressly granted are reserved by Nation and its licensors.

You must use the Platform lawfully, responsibly, and in a manner consistent with its intended purpose.

You shall not, and shall not permit any third party to:

• violate any applicable law, regulation, court order, or third-party right;
• upload, post, transmit, submit, or otherwise make available unlawful, defamatory, fraudulent, misleading, discriminatory, abusive, harassing, hateful, infringing, or malicious content;
• impersonate any person or entity, misrepresent your identity, affiliation, experience, qualifications, or authority;
• misrepresent your skills, work history, credentials, certifications, compensation expectations, availability, or application status;
• post fake jobs, fake profiles, fake employer information, or misleading hiring opportunities;
• submit viruses, malware, spyware, malicious scripts, or other harmful code;
• interfere with, disrupt, damage, overburden, or compromise the integrity, performance, availability, or security of the Platform;
• bypass, disable, or interfere with security controls, authentication measures, rate limits, or access restrictions;
• scrape, crawl, spider, harvest, extract, index, monitor, or collect data from the Platform by automated means, including for dataset creation, AI training, competitive intelligence, or bulk reuse, except where Nation expressly permits it in writing;
• use bots, agents, automation, or scripted workflows in a manner not authorized by Nation;
• use the Platform for spam, phishing, fraud, unlawful solicitation, deceptive recruiting, or unauthorized advertising;
• access another user’s account, data, or content without authorization;
• use the Platform in a way that could expose Nation, its users, its customers, or its partners to legal, security, operational, or reputational harm.

Nation may investigate suspected misuse and may suspend, restrict, remove, or terminate access where justified.

The Platform may enable you to create a profile, publish professional information, express interest in opportunities, apply for jobs, participate in assessments, or receive recommendations.

You are solely responsible for the accuracy, completeness, legality, and appropriateness of any information you provide, including:

• identity and contact information;
• work history and education;
• skills, projects, portfolios, code samples, certifications, and assessments;
• compensation, location, work authorization, and availability;
• job applications, messages, and communications with employers or other users.

Nation may use your profile and activity data to operate the Platform, improve user experience, support matching and recommendations, prevent misuse, and provide features consistent with these Terms and the Privacy Policy.

Nation does not guarantee that any profile will be viewed, that any application will receive a response, or that any use of the Platform will result in employment, interviews, commercial opportunities, or learning outcomes.

Employers and other third parties are solely responsible for their own recruiting, evaluation, interview, hiring, and commercial decisions.

The Platform may provide skills testing, assessments, rankings, scores, benchmark signals, recommendations, learning content, learning paths, or similar outputs.

You acknowledge and agree that:

• such features may depend on software, rules, AI systems, statistical models, probabilistic methods, human review, or combinations thereof;
• outputs may change over time as the Platform, methodologies, data, or features evolve;
• scores, rankings, badges, benchmarks, recommendations, and similar outputs are informational and product features only;
• unless explicitly stated otherwise by Nation in writing, such outputs do not constitute certification, formal accreditation, guaranteed competence, guaranteed employability, or guaranteed job readiness.

Nation may update, refine, suspend, or discontinue any scoring, ranking, assessment, or benchmark methodology at any time.

You may submit, upload, post, share, transmit, or otherwise make available content, including profile information, text, code, files, portfolio materials, messages, comments, job applications, and other materials (“User Content”).

You retain ownership of your User Content as between you and Nation.

However, by submitting or making available User Content through the Platform, you grant Nation a worldwide, non-exclusive, royalty-free, transferable to affiliates, sublicensable as necessary, license to host, store, reproduce, process, adapt, format, analyze, display, transmit, distribute, and otherwise use such User Content solely to the extent necessary to:

• provide, operate, maintain, and secure the Platform;
• enable Platform features and workflows;
• display your profile or submitted materials in accordance with your use of the Platform;
• support applications, employer workflows, and user interactions initiated by you or reasonably connected to Platform operation;
• improve the Platform, including its usability, safety, integrity, and functionality;
• comply with legal, regulatory, audit, or enforcement obligations;
• investigate fraud, abuse, violations, and security incidents.

You represent and warrant that:

• you own or control all rights necessary to submit the User Content;
• the User Content does not violate these Terms, applicable law, or any third-party right;
• the User Content is not false, misleading, or fraudulent in any material respect.

Nation is not obligated to monitor all User Content, but may remove, restrict, or disable access to any User Content at its discretion where justified by legal, policy, security, operational, or reputational considerations.

The Platform, including all software, code, architecture, interfaces, workflows, models, prompts, datasets owned by Nation, design elements, visual assets, text, branding, trademarks, logos, content arrangement, documentation, assessment methodologies, scoring logic, analytics structures, and all related intellectual property rights, are and remain the exclusive property of Nation or its licensors.

Except for the limited license expressly granted under these Terms, no right, title, or interest in or to the Platform is granted, assigned, or transferred to you.

You shall not remove, alter, obscure, or circumvent any copyright, trademark, confidentiality, attribution, or proprietary rights notices.

The Platform may include AI-powered, rule-based, or otherwise automated features for recommendations, search, matching, analysis, scoring, moderation, assistance, drafting, summaries, or other workflows.

You acknowledge and agree that:

• AI and automated outputs may be probabilistic, incomplete, inaccurate, biased, outdated, or otherwise imperfect;
• outputs may vary for the same or similar inputs;
• AI or automated features are provided for convenience and informational purposes only unless expressly stated otherwise;
• such outputs do not constitute legal, financial, tax, employment, recruiting, educational, or professional advice;
• you remain responsible for reviewing and exercising judgment regarding any output, action, application, communication, or decision connected to your use of the Platform.

To the extent required by applicable law, Nation will implement appropriate safeguards where solely automated decision-making may have legal or similarly significant effects.

Certain parts of the Platform may be offered on a paid basis or under separate commercial terms.

Where applicable:

• fees, billing terms, entitlements, restrictions, and service scope will be presented at purchase, in an order form, or in separate commercial terms;
• unless otherwise stated or required by law, fees are non-cancellable and non-refundable;
• Nation may suspend or limit access for non-payment, chargebacks, suspected fraud, abuse, or breach of applicable commercial terms.

Paid features may be subject to additional terms, and in the event of conflict, those specific commercial terms govern with respect to the relevant paid service.

The Platform may include integrations with, links to, or dependencies on third-party services, content, websites, software, data sources, communication tools, or employer systems.

Nation does not control and is not responsible for third-party services or content except to the extent required by mandatory law.

Your use of third-party services may be subject to separate third-party terms and privacy practices.

Nation’s processing of personal data is governed by the applicable Privacy Policy and, where relevant, additional notices or contractual terms.

By using the Platform, you acknowledge that Nation may process personal data and usage data as necessary to operate the Platform, provide features, maintain security, improve services, support applications and matching, comply with law, and enforce these Terms, all in accordance with applicable data protection law.

Nation may, with or without prior notice where justified, suspend, restrict, disable, remove, or terminate your access to all or part of the Platform if:

• you breach these Terms or other applicable policies;
• Nation reasonably suspects fraud, misuse, unlawful activity, or security risk;
• your account, conduct, content, or activity creates risk for Nation, other users, customers, partners, or third parties;
• Nation is required to do so by law, regulation, court order, or competent authority;
• continued provision of the Platform or a feature is no longer commercially, technically, or legally feasible.

You may stop using the Platform and close your account at any time, subject to any separate commercial commitments you may have entered into.

Upon termination or suspension:

• your right to use the Platform ceases immediately to the extent specified by Nation;
• Nation may disable access to your account, profile, or User Content;
• Nation may retain data as required or permitted by law, for legitimate business purposes, dispute resolution, security, backup, audit, or enforcement.

To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis.

Nation does not warrant that:

• the Platform will be uninterrupted, error-free, secure, or always available;
• defects will be corrected within any specific timeframe;
• the Platform will meet all of your expectations or requirements;
• any job, employer, user, content, opportunity, learning path, assessment, score, recommendation, benchmark, or AI output will be accurate, complete, reliable, suitable, or successful;
• use of the Platform will lead to employment, interviews, commercial gain, education outcomes, or professional advancement.

To the fullest extent permitted by law, Nation disclaims all express, implied, statutory, and other warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

To the fullest extent permitted by applicable law, Nation shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, or for any loss of profits, revenue, business, goodwill, opportunity, data, anticipated savings, or reputation, arising out of or in connection with the Platform or these Terms.

To the fullest extent permitted by law, Nation shall also not be liable for:

• third-party conduct, content, or decisions, including employer decisions, user conduct, or communications;
• unsuccessful applications, hiring outcomes, missed opportunities, or reliance on Platform recommendations, rankings, benchmarks, or AI outputs;
• interruptions, delays, outages, bugs, security incidents, or data loss not caused by Nation’s gross negligence or willful misconduct;
• unauthorized access resulting from your failure to secure your account or devices.

If, notwithstanding the foregoing, Nation is held liable for any claim arising out of or in connection with these Terms or the Platform, Nation’s aggregate liability shall be limited to the greater of:

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless Nation, its affiliates, and their respective directors, officers, employees, contractors, and representatives from and against any claims, demands, actions, proceedings, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Platform;
• your User Content;
• your breach of these Terms;
• your violation of applicable law or third-party rights;
• your misuse of profiles, applications, employer workflows, assessments, data, AI features, or community tools.

Nation may modify, update, suspend, or discontinue the Platform, in whole or in part, at any time.

Nation may amend these Terms from time to time. Updated Terms will become effective when posted or otherwise communicated, unless a later effective date is stated.

Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms.

If you do not agree to an amendment, you must stop using the Platform.

These Terms are governed by the substantive laws of Sweden, without regard to conflict of laws principles.

Any dispute arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden, unless mandatory consumer or data protection law requires otherwise.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Nation’s failure to enforce any provision shall not constitute a waiver of that provision or any other right.

You may not assign or transfer these Terms or any rights under them without Nation’s prior written consent. Nation may assign these Terms or any rights or obligations under them as part of a corporate reorganization, financing, acquisition, merger, sale of assets, or by operation of law.

These Terms constitute the entire agreement between you and Nation regarding your use of the Platform, except for any separate commercial terms, order forms, or policies expressly incorporated by reference.
